• These General Conditions of Sale point out the rights and obligations of the user (Hereinafter the “Customer”) relating to the products sold by the company Selim Mouzannar (Hereinafter the “Company” / Selim Mouzannar) in the electronic catalogue of the website www.selimmouzannar.com using a distance selling system.
  

• The contract, established in case of an effective order, the conditions referred to in these general conditions of sale, are concluded in accordance with the regulations of distance selling, as it results in particular from the Lebanese Consumer Code, as well as the specific provisions referred to hereinafter.

• The order involves irrevocable acceptance of the general conditions of sale. The Customer declares to have the capacity to conclude this contract i.e. to have reached legal age and not to be under guardianship or to have the power to represent a legal person.

• The Approval without reserve of these general conditions of sale will consist in the fact, for the Customer, when checking the box "I accept the general conditions of sale". Checking this box will be deemed to have the same value as a handwritten signature on the part of the Customer.

OUR PRODUCTS

All our products are made in our workshop located in Beirut, we recycle the gold daily from returned, transformed and repaired products.

All Selim Mouzannar jewelry is 18 karat / 750 thousandths gold, the state hallmark is present on all gold coins and certifies their quality. Selim Mouzannar ensures its customers that all products containing gold have been provided in accordance with mineral sourcing protocols from non-conflict countries, and respect Wall Street's reforms on consumer protection.

• The diamonds used by Selim Mouzannar SARL have the D- E- F or G (color) and VVS-VS or SI (Clarity) classification and are subject to a GIA certificate of authenticity delivered with the jewel for larger diamonds at 0.50 carat.
  

• Rose cut diamonds (old cut with fewer facets than modern cuts and more random shapes) do not enter with the GIA classification, but Selim Mouzannar provides the best quality.

• Diamonds are purchased from lawful companies not involved in conflict financing and are subject to written guarantees from their supplier. We hereby guarantee that its diamonds come from countries not linked to conflicts, in compliance with the resolutions and rules established by the United Nations.

• The precious stones selected by Selim Mouzannar are rigorously chosen for their color qualities, clarity and brilliance and are subject to a certificate of authenticity delivered with the jewel, in particular GIA for diamonds over 0, 5 carat.

• The products to be sold are those appearing on the Site when the Customer consults the Site. The Site does not sell second-hand, defective or substandard products compared to the standards offered in the market.

• We draw the Customer's attention to the fact that the photos illustrating our products may appear slightly different from reality due to the settings of the Customer's screen and the lighting during the shooting. In addition, as these are handcrafted creations, the items may exhibit irregularities in finishing, differences in format and / or colors inherent in this type of manufacture which cannot be considered as major defects. The responsibility of the Company cannot be reconsidered and the validity of the order cannot be affected.

• The photographs, graphics, and descriptions of the products to be sold are only indicative and in no way bind the Selim Mouzannar Company. Customers have the option of obtaining further information by contacting the Company's Customer Service by email at the following address: info@selimmouzannar.com.

PRODUCT PRICES AND INTERNATIONAL ORDERS

• The selling prices of the products are displayed on the Site at the time of purchase by the Customer. These prices are indicated including taxes.
  

• Invoicing at the time of check-out is always done in dollars including taxes, at the rate applicable at the same time. Any change in this rate will be automatically reflected in the selling price of the products.

• After sending an email of order confirmation with the package tracking number, a second email is sent to the Customer to inform him of the amount of applicable taxes and customs duties, which they will have to pay to the carrier at the time of the delivery.

ORDER TERMS

• The creation of a personal account is mandatory to place an order on the Site.

• The sale will not be considered final until the Customer has sent the acceptance confirmation of the order by the Company by email and after receiving the full price by the latter.
  

• It is the Customer's responsibility to verify the accuracy of the order and to immediately report any errors. The Customer certifies having received a detail of the delivery costs, as well as the terms of payment, delivery and execution of the contract.

• Any order placed on the Site constitutes the formation of a contract concluded at a distance between the Customer and the Company.

• The Company reserves the right to cancel or refuse any order from a Customer with whom there is a payment dispute of a previous order.

The Customer can find all the information relating to his order (invoice, parcel tracking number and contact details) in the “My Account” section.

• The Company should not sell the Products on the Site to professionals, but only to consumers, for their personal needs. The Seller therefore retains the right to refuse orders for the same Product in large quantities and comprising more than 10 identical items.

• Once the contract has been concluded, the Company sends the Customer, by email, a receipt of his order containing a summary of the information provided on the order form, as well as the link of a withdrawal form.

• The languages available for concluding the contract on the selimmouzannar.com site are French and English. The final price of the basket will be displayed once the aforementioned charges are booked.

PAYMENT

• For the payment of the sale price of the products and shipping costs, the Customer must follow the instructions written in the order form.

• The Customer has the possibility of paying their purchases by debit/credit card, or by bank transfer. The currency of payment is US Dollar. The accepted payment cards are: CB, MasterCard®, Visa®, American Express®.

• As soon as the payment is accepted by the Site, a validation email is sent to the Customer, accompanied by the invoice.

• In the case of payment by bank transfer, the Customer has eight (8) working days from the confirmation of the order to transfer the agreed amount. A reminder will be sent to the Client within 8 days if the expected sum is not transferred to the Company's bank account. The order may be canceled if the Customer has not made the bank transfer within the time limit.

• During payment, the bank requests personal information from the Customer in order to verify the identity of the cardholder and to validate the transaction. The Customer must submit his credit card number, depending on the type of the latter, the expiration date thereof as well as the cryptogram number (appearing on the back of the bank card).

• The Customer guarantees the Company, when validating his order form that he is in good standing towards the issuer of the payment card.

• Financial information will be transferred by means of a cryptographic protocol to other banks providing services related to remote electronic payment, without third parties being able to access it under any circumstances.

SHIPPING & DELIVERY

Availablity:

• All our products are handmade in our workshop and production takes up to 5 weeks after order confirmation (excluding weekends and holidays) and unless otherwise specified by us. Only then and email will be sent to confirm order processing and shipment. 

Delivery:

• Delivery is constituted by the transfer of physical possession to the Customer or control of the Product.

• The covered delivery area includes France, United Kingdom, Switzerland, United States, United Arab Emirates, Hong Kong, and Australia, in partnership with DHL EXPRESS. For other countries, the order must be sent directly for review to our sales departments by email to info@selimmouzannar.com. Our services will take care of validating the order and following up with the Customer.
  
  

   
  

• Once you place your order need 4 to 8 weeks to deliver your item, depending on product availability and the delivery country. 
  
  
  

 

• Delivery time limits are 5 working days and are counted starting from the date of shipment of the order confirmed by email. Any possible delay related to the customs clearance of the exported goods is not the responsibility of the Company.

• Absence or Delay in delivery: The Company undertakes to make its best efforts to deliver the products ordered by the Customer within the deadlines specified above. These deadlines are provided for information only.

If, after thirty (30) days and exception cases of force majeure, the Customer has not received the package, the Customer must notify the Company by registered letter with acknowledged receipt or in written in another durable support. In this case, the Company undertakes to reimburse the Customer, within ten (10) working days of the cancellation request.

In accordance with the legislation in force, the transfer of risk takes place with the physical possession or control of the Product by the Customer.

• Insurance: Each package is insured, regardless of the carrier and the value of the jewelry (s), so that if a package is lost or damaged during transport, we suggest a delivery of an identical product or else a reimbursement if the Customer prefers, if the product is not immediately available.

• Tracking: We track each of our shipments and you have the possibility to track your order thanks to a tracking number which is provided via email when your package is dispatched [see above].

• The ordered product is delivered to the address on the Customer's order form.

 

• For security reasons, we are not able to deliver to P. O. Boxes. When the product is delivered, check the content of the products delivered and their conformity with your order before signing the carrier's delivery note. In the event of an anomaly, please let us know your reservations within 5 days by emailing at the following address: info@selimmouzannar.com, otherwise, we cannot be liable. If you are absent during the delivery of your package, you will need to contact the carrier to arrange a new delivery.

• The delivery address may differ from the billing address.

• In the event of damage, the Customer expresses his reservations with precision and clarity on the delivery slip, a duplicate of which is sent by the carrier to the Company. In this regard, it is the Customer's responsibility to verify the content, conformity and condition of the product upon delivery. This verification is deemed to have been carried out once the Customer, or a person duly authorized by it, has signed the delivery slip presented by the recipient of the carrier.

• Despite the care taken in preparing the orders, a product may be missing, or an error may have occurred during the preparation. If you notice such an error, please report it to us by email at info@selimmouzannar.com within 48 hours maximum following receipt of the order.

• Each order is carefully packaged in a Selim Mouzannar Box slipped into a branded fabric bag which also contains a leather pouch to protect the jewel on a daily basis. We prepare your package by hand, which will be shipped in a white, secure and anonymous cardboard box. In addition to your jewelry, this package contains an envelope with the certificate of authenticity, the invoice and a card with tips for taking care of your jewelry.

• If it is a gift and you do not wish to attach the invoice to it, all you have to do is indicate this during the purchase process by checking the box "This is a gift, do not attach the invoice with the parcel”.

   

• www.selimmouzannar.com will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of Lebanon

 

• Multiple transactions may result in multiple postings to the cardholder’s monthly statement

Cancellation:

• You have 48h after placing your order to make a cancellation
  
  
  
• Refunds will be made onto the original mode of payment and will be processed within 10 to 45 days depends on the issuing bank of the credit card

RETURNS

We only replace items if they are defective or damaged. If you need to exchange an item for the same item due to a request of change of size, send us an email at “Info@selimmouzannar.com”.

Right of withdrawal and return:

• The Customer has a period of fourteen (14) days to retract (article 55 new law number 659 dated February 04, 2005 relating to consumer protection), without justification, nor payment of penalties, except for products produced on order that cannot be exchanged or refunded. The Customer will be reimbursed after having returned the product under the conditions indicated below.

The fourteen-day time limits accrue:

• Starting from the day on which the customer or a third party, who is not the carrier, designated by the Customer receives / comes into possession of the ordered item.

• Or, in case of an order of several items delivered separately, starting from the day on which the Customer, or a third party who is not the carrier, designated by the Customer, received the last article.

• The Customer must notify the Company of his decision to withdraw by email at the following email: info@selimmouzannar.com. The Customer may use the provided standard form at the end of these general conditions.

After receipt and verification of the products returned by the Customer, the Company will reimburse the payments received within fourteen (14) working days and in the event of a return of a global order (the totality of the products ordered in a single order) the shipping cost. The Customer will not be liable of the “standard” delivery costs (the most economical). The Company will reimburse them.

If they have chosen a delivery method other than the standard delivery method, the additional billed charges will not be refunded. - However, we will only accept exchange and refund of jewelry if all of the following conditions are met:

1) The product must not have been worn, used, modified, washed, damaged or deteriorated.

3) The product must not have been made to measure / made to order according to article 55 of Lebanese Law.

2) The product must be returned in its original packaging accompanied by the purchase invoice.

• Upon Receipt of the returned product, the refund will be made according to the buyer's wishes in the form of a credit note valid for 6 months on the Site or a refund credited directly to his bank account depending on the method of payment used when ordering.

CLEANING AND CARE

Jewelry is precious and should be treated with the utmost care. Some precautions are necessary to maintain their beauty and shine:

• Jewelry does not like cosmetics, humidity in bathroom, sand and sea, playing sports or doing a manual activity, [detergents, eau de javel, ammonia or alcohol].

• When you are not wearing your jewel, store it in its leather pouch or Selim Mouzannar case to protect it from any shock or scratches. It is not recommended to store several pieces of jewelry in the same box as they could get scratched by friction.

• Your jewelry can be cleaned to intensify their shine: rub them gently with a soft toothbrush and soapy water, then rinse with hot water and dry with a soft cloth or with a hair dryer on cold air.

REPAIR & GUARANTEES

• The Customer has a period of one (1) year from receipt of the product to request repair thereof at no cost. In the event of a hidden defect (default of crimping, defective chain or clasp), the Customer can choose between the resolution of the sale or a credit note.

• Beyond one year from receipt of the product, the Company will take care of all repair requests which will be the subject of a quotation. The costs of shipping the product to the Selim Mouzannar workshop will be borne by the customer, the return costs will be borne by the Company. The repair time limits for a product starting from receipt are of four weeks.

• For information, black gold corresponds to a surface treatment applied to 18 carat gold.

• Over time, this coloring may fade, more or less quickly, depending on the acidity of the skin and the products to which it may be exposed (creams, perfume, cleaning products, etc.).

Selim Mouzannar offers "Rhodium” and cleaning the jewelry purchased from our shop in order to restore them to their original color, once every three years.

RESIZING

• The Customer has one (1) year starting from the date of receiving the product to request its reparation free of charge. If the ring, bracelet, or necklace is too big or too small, the Customer can return it to us within one year of the date of receipt and our workshop will readjust the jewel while respecting its original shape.

• Beyond one year after receipt of the product, the size will be subject of a quotation. The costs of shipping the product to the workshop will be borne by the Customer, the return costs will be borne by Selim Mouzannar. The time it takes to scale up a product from receipt is around four weeks.

HALF-MADE OR CUSTOM-MADE CREATIONS

Selim Mouzannar likes to offer his clients the opportunity to contribute in the creation of their own jewelry in the spirit of the brand, as it is a story that anyone can write based on their tastes and desires. The personalized orders allow the Customer to imagine a unique design or incorporate a family stone. On existing models, the Customer will be able to choose the color of the gold (yellow, pink, white), the type of stones and the enamel colors that they particularly like.

Upon receipt of the quotation request, a first drawing with a first estimation of feasibility, budget and deadlines will be sent to the Client, and may be the subject of discussions in order to reach the final project.

Any half-measure or tailor-made order must be paid in full when ordering.

Special orders are made within a minimum of 6 weeks (except delay in case of force majeure), but the duration depends on the complexity of the project.

Semi-made or custom orders are not subject to return or exchange.

INTELLECTUAL PROPERTY

• The Site is the property of the Company. It is protected by International Copyright Laws and Agreements, as well as other International Intellectual Property Laws and treaties.

• All rights relating to the Site and to the overall concept of the Company's activity, to their original and innovative character, in particular intellectual property rights on texts, literary and artistic creations, graphics (including photographs) and audiovisual, including advertising, IT developments, HTML developments and other intellectual works and, in general, all creations likely to be protected by intellectual property law such as images, logos, formatting, graphic charter, structure, ergonomics, color codes, typography, fonts, basic graphic elements, graphic organization of the screens, layout, page backgrounds, visual identity of the Site, belong to the Company or are regularly used by the latter, without any limitation.

• The Customer agrees not to directly or indirectly infringe the Company, the Site, or the rights of the Company.

PERSONAL INFORMATION AND COOKIES

• The delivery of the order requires the provision of a certain amount of personal information concerning the Customer, namely his name, first name, postal address, date of birth, phone number and email address. The data collected is necessary for the fulfillment of the Company's obligations towards it, such as the validation of the order, or the execution of the delivery. The Customer not wishing to provide this information will not be able to place an order on the Site.

• The Customer's data is kept for this sole purpose and the Company undertakes not to use them in any other context, nor to transmit them to third parties, without the express consent of the Customer or outside the cases duly provided. The data controller, except for data relating to payment, is the Company, whose contact details are given in article 2. The contact details of Customers are kept for a period of 3 years starting the end of the Business relationship. These data are kept in secure conditions, according to current technical means.

• The transmission of information on the Site takes place in a secure context using the protocols in force in the Internet.

• Payment card numbers are not kept in the Site but in the secured site of our banking institution.

• In accordance with Law number 78-17 of January 6, 1978 relating to computers, files and freedoms, you have the right to access, rectify, and oppose your personal data. To do so, simply send us a request online, indicating your name (s), first name (s), address and, if possible, your customer reference to info@selimmouzannar.com.

COOKIES

• Use of cookies: Under its own responsibility or that of a third party engaged for the provision of tracking services, the Site may use cookies when an Internet user browses the Site. Cookies are files sent to the browser by means of a web server in order to record the activities of the Internet user while they are browsing.

• The use of cookies allows the server where the Site is located to recognize the web browser used by the user in order to facilitate navigation as much as possible, allowing, for example, access to users who have already registered to access the areas, services, promotions or contests which are exclusively reserved for them without having to register for each visit. By eliminating cookies from the Site or by disabling them, the Internet user is at the risk of not being able to access certain features of the Site.

• In order to use the Site, users are not required to allow the installation of cookies, but they shall restart the session per se in each services whose performance requires prior registration or session start.

• What types of cookies does the Site use? The Site uses four types of cookies:

• Technical Cookies: They allow the Internet user to browse the Site and use features such as the shopping cart or the Wishlist.

• Analysis Cookies: The Site uses Google Analytics cookies to quantify the number of users who visit the Site. These cookies make it possible to measure and analyze the way in which Internet users browse the Site. This information allows the Company to continuously improve its services and to facilitate the purchasing process for users of the Site.

• An IP address is a number automatically assigned to a computer when it connects to the Internet. APPLICABLE LAW

• These general conditions of sale are governed by Lebanese law, with the exception of Law number 78-17 of January 06, 1978 relating to information technology, files and freedoms, and any other applicable international convention Including the Vienna Convention on the International Sale of Goods of April 11, 1980.

• In the event of a dispute with a client, the Lebanese courts are competent.
